Who we are

These Terms of Service ("Terms") apply when you use mythumi.com or order from MYTHUMI ("we" or "us"), a business located in Burlington, Ontario, Canada.

By using the site or ordering, you agree to these Terms, which include our Refund policy and Shipping policy. Our Privacy policy explains how we handle personal information. If you do not agree, please do not use the site.

Nothing in these Terms limits any rights you have under applicable consumer protection law, including Ontario's Consumer Protection Act, 2002, or any law that replaces it. If these Terms and that law differ, the law applies.

Who can order

You must have reached the age of majority where you live to place an order. If you have not, a parent or guardian must place the order and accept these Terms.

How custom orders work

• Upload and choose. In the creator, you upload a photo (or, where offered, a sketch, reference image or written description), pick a style and may add up to 300 characters of instructions.
• Preview. We create a design preview using AI tools. Before you order, you can try again or use another photo.
• Approve and order. You approve your preview in the creator, then add it to your cart and check out, which confirms that approval.
• Made to order. Our artists then refine the digital 3D model from your approved preview and instructions, and we print your figurine in full colour.

Where a product page asks you to pick the closest style and describe the look in the instructions box, your preview may not fully show that look, and our artists interpret your description.

Not every instruction can be reproduced in print. If we can't reasonably follow an important one, we will contact you before printing, and you can go ahead with your approved preview or cancel for a full refund. Because each piece is personalised, please check your photo, preview, size and instructions before checkout. Cancellations, returns and refunds are covered in our Refund policy.

After checkout, we email you an order confirmation. Please keep it for your records.

We currently ship only within Canada. Other destinations may be added later, and checkout shows what is available for your address. See our Shipping policy.

Prices, taxes and errors

Prices are in Canadian dollars (CAD). If you see amounts converted into another currency, the currency and total at checkout are what you pay. We charge the full order amount at checkout, and applicable taxes and shipping are shown there before you pay.

If an item or option is wrongly priced or described, or an option you chose is not charged at checkout, we will contact you before making your figurine; you can then pay the correct price or cancel for a full refund. We may also cancel an order with a full refund if an option is unavailable or we cannot make the item.

Your photos, sketches and instructions

"Your content" means anything you upload, type or send us, such as photos, sketches, names, dates and instructions. You keep ownership of it. By submitting it, you confirm that:

• you own it, or the owner has given you permission to use it this way;
• every identifiable person in it has agreed to being made into a figurine, and a parent or guardian has agreed for anyone under the age of majority; and
• it is lawful and does not infringe anyone's copyright, trademark, privacy or other rights.

Content we will not make

We will not make figurines from content that, in our reasonable judgment:

• is hateful, harassing or discriminatory;
• is sexual or nude, or sexualises anyone who is or appears to be a minor;
• is graphically violent or promotes violence, self-harm or crime;
• uses characters, logos or other protected material you have no right to use; or
• impersonates, misleads, defames or bullies someone, or is otherwise unlawful.

We may refuse or cancel an order that breaks these rules, before or after checkout, with a full refund, and will report unlawful content to the authorities where the law requires.

Permission you give us

You give MYTHUMI a limited, non-exclusive, royalty-free permission to store, copy, edit and process your content, including with AI and 3D modelling tools run by us or our service providers, only to create your previews and keep them in your gallery, make and deliver your order, provide support and keep records the law requires.

We will not use your photos, previews or finished figurine in advertising, social media or a portfolio without your separate, express permission, which you can withdraw at any time.

How long we keep uploads

We keep uploaded photos, previews and production files only as long as we reasonably need them for these purposes, then delete them (order records the law requires are kept longer). You can ask us to delete your uploads at any time, although that may stop an order still in production.

Previews and site images

Design previews are AI-generated and approximate. Because of artist refinement, the limits of full-colour 3D printing and how screens show colour, your figurine may differ from the preview in likeness, colour, proportions and fine detail.

Product and style images on our site are AI-generated illustrations of a style, and other example photos may be AI-generated or AI-edited. None of them shows your order, and your figurine will not look exactly like them.

Your purchase is a physical figurine only; the 3D model and print files are not included.

Our intellectual property

The MYTHUMI name, logo, site and creator tool belong to MYTHUMI or its licensors. Please do not copy, scrape or resell the site, interfere with how it works, or use our branding without our written permission. The figurine you buy is yours to keep, display or give away.

Using your figurine safely

Our figurines are display pieces, not toys. Small or thin parts can break off and could be a choking hazard, so keep figurines and any broken pieces away from young children.

Warranties

Your order comes with the warranties and conditions that consumer protection law gives you, and we do not exclude them. If an order arrives damaged, defective or wrong, see our Refund policy.

We do not promise an exact match to your photo or preview, or that the site will always be available or error-free.

Limitation of liability

To the extent the law allows, MYTHUMI is not liable for indirect or consequential losses, including lost profits or data, and our total liability for a claim about an order is limited to what you paid for that order. This does not limit any liability or remedy that consumer protection law does not allow us to limit.

Claims caused by your content

If a third party claims against us because you submitted content you had no right to use, such as someone's photo without permission, you agree, to the extent the law allows, to cover our reasonable resulting losses and costs, including legal fees.

Governing law

Ontario law, and the federal laws of Canada that apply in Ontario, govern these Terms, and disputes go to the courts of Ontario. This does not remove any right consumer protection law gives you to bring a claim where you live or to rely on your local law.

Changes and severability

We may update these Terms by posting a new version here with a new "Last updated" date. The Terms in effect when you place an order apply to that order. If any part of these Terms is found unenforceable, the rest still applies.
